How to Replace a Qualifying Individual With CSLB

When the qualifying individual leaves your company, a countdown starts. You have 90 days to name a replacement or CSLB suspends the license. Once suspended you cannot legally bid, contract, or perform work.

The 90-day rule

When a qualifier disassociates from a license, the licensee has 90 days from the date of disassociation to replace them. Either the licensee or the qualifier must notify CSLB in writing within that same 90-day window.

Miss the deadline and one of two things happens: the license is automatically suspended, or if the qualifier was only qualifying one classification on a multi-classification license, that classification is removed.

Can you get more time?

A 90-day extension can be requested, but it is not automatic and it is not available just because you were slow. An extension will only be considered if the request arrives within 90 days of CSLB’s notice, an application to replace the qualifier has already been filed, and specific circumstances apply, such as a dispute over the actual disassociation date.

Treat the extension as a backstop for genuine complications, not as a second 90 days.

What the replacement involves

1. Notify CSLB of the disassociation in writing, within 90 days.
2. Identify the new qualifier. They must meet the experience requirements for the classification and be eligible to serve as RMO, RME, or sole owner.
3. File the Application to Replace the Qualifying Individual with the required documentation.
4. Provide experience or waiver evidence. The new qualifier generally needs four years of journey-level or higher experience within the last ten years, verifiable through payroll records, unless an examination waiver applies.
5. Post any required bond. If the new qualifier is an RME rather than an officer or member, a Bond of Qualifying Individual is required.
6. Wait for approval. The replacement is not effective until CSLB approves it.

Why companies run out of time

They start looking on day 60. Finding a qualified individual in the right classification takes time, and so does CSLB processing.

The disassociation date is disputed. If you and the departing qualifier disagree on when they left, the clock may have started earlier than you think.

Experience documentation is thin. The new qualifier’s experience must be verifiable. Vague certifications get rejected, and a rejection burns weeks.

Nobody was notified. Written notice to CSLB is a separate obligation from filing the replacement.

How to protect yourself in advance

• Put a notice period in the RMO agreement so a departure is never a surprise
• Know who your backup candidate is before you need one
• Keep experience documentation for potential qualifiers current
• File the replacement application immediately, not near the deadline
