How CSLB Qualifying Individuals Work

Behind every California contractor license there is one person whose experience and exam record makes that license valid. CSLB calls them the qualifying individual. Everything else about the license depends on them.

This guide explains who can be a qualifying individual, what they are responsible for, and what happens when they leave.

What a qualifying individual is

The qualifying individual is the person whose credentials the license is built on. They have documented the required trade experience and passed the required examinations, and CSLB holds them accountable for the licensed company’s construction work.

Every CSLB-licensed business must have one. There is no such thing as a California contractor license without a qualifying individual behind it.

The three forms it can take

Depending on the business structure and the person’s relationship to it, the qualifying individual is one of:

  • Sole owner. The individual owner personally qualifies the license.
  • Responsible Managing Officer (RMO). An officer, director, or partner of the company. May hold equity, and with at least 20% ownership plus prior CSLB approval may qualify up to three corporations.
  • Responsible Managing Employee (RME). A W-2 employee actively engaged at least 32 hours per week or 80% of the company’s operating hours. May not hold ownership and may not qualify any other active license.

What it takes to qualify

Experience

At least four years of journey-level or higher experience in the classification being applied for, obtained within the last ten years. The work must have been performed at the level of journeyman, foreman, supervising employee, or contractor, and it must be verifiable through payroll records or comparable documentation.

This is where most applications stall. Vague or unverifiable experience claims get rejected.

Examinations

The Law and Business examination plus the trade examination for the classification. Both can be waived in narrow circumstances, which we cover in our guide to getting licensed without the exam.

Certification

Experience is documented on a Certificate of Work Experience, signed by someone with direct knowledge of the work, such as a former employer or supervisor.

What the qualifying individual is responsible for

The legal standard is direct supervision and control. Business and Professions Code section 7068.1 defines it as any one or any combination of:

  • Supervising construction
  • Managing construction activities by making technical and administrative decisions
  • Checking jobs for proper workmanship
  • Direct supervision on construction job sites

The phrase “any one or any combination” gives real flexibility. It does not give permission to be absent entirely. A qualifier with no involvement in the business creates exposure for the company and for themselves.

When a qualifying individual leaves

This is the part that catches companies off guard, so it is worth planning for before it happens.

When a qualifier disassociates, the licensee has 90 days to replace them. CSLB must be notified in writing within 90 days of the disassociation date. Miss the window and the license is automatically suspended, or the classification is removed.

A 90-day extension can be requested in limited circumstances, such as when an application to replace the qualifier has already been filed or the disassociation date is disputed. Extensions are not guaranteed.

While the license is suspended you cannot legally bid, contract, or perform work. For most contractors that is the real cost, not the paperwork.

What to do about it

  • Know your qualifier’s intentions before they act on them
  • Put termination and notice terms in the written agreement
  • Line up a replacement before you need one
  • File the replacement application immediately, not at day 85

Can one person qualify more than one license?

An RMO can qualify up to three corporations at the same time, but only with prior CSLB approval and generally with at least 20% documented ownership in each company. An RME cannot qualify any other active license at all.
